Tax refund for young people purchasing their first home – what do you need to know?

1. Who is eligible for the tax refund?

• Citizenship: Croatian citizenship is mandatory;

If you purchase a property within the tolerance limit (e.g., a 70 m² apartment for 1 person), the tax refund is calculated proportionally based on the prescribed 50 m², while the remaining square footage is not subsidized. If the property exceeds the maximum tolerance limit, eligibility for the subsidy is forfeited.
B) Average price per square meter criterion
The calculation is based on official average real estate prices by city and municipality.
• If the agreed price per square meter is lower than or equal to the local average, the refund is calculated based on the actual amount paid. • If the agreed price exceeds the local average, the refund is calculated based on the official average price.
• If the price per square meter is more than 50% higher than the local average, the property is classified as luxury, and the right to a refund cannot be exercised.

4. Step-by-step: Application process and required documentation
The tax refund application must be submitted to the Agency for Transactions and Mediation in Immovable Properties (APN) at Savska cesta 41/VI, Zagreb (either in person or by mail) within 24 months of the contract conclusion or the acquisition of ownership.

In order to prevent abuses, the law clearly defines the obligations of the beneficiary of the grant. The user is obliged to return the paid amount with default interest if within 5 years from the date of payment:
• alienate (sell, donate) or rent real estate;
• deregister residence from the address of that property;
• does not reside in that property.
Also, the right to a refund cannot be exercised by citizens who have already used other state housing subsidies for the same property (such as earlier APN subsidized loans).
